Welcome to Trithos Health. These Terms of Use (“Terms”) govern your access to and use of the website trithoshealth.com (the “Site”) and any products, services, or content offered through the Site.
By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Site.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes your acceptance of the new Terms.
2. Eligibility
You must be at least 18 years old to use this Site or purchase products from us. By using this Site, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
3. Products and Descriptions
We strive to provide accurate product descriptions and images. However, we do not warrant that product descriptions, images, pricing, or other content on the Site is accurate, complete, reliable, current, or error-free.
Our products, including creatine supplements, are intended for use by healthy adults as part of a balanced diet and exercise program. Our products are not intended to diagnose, treat, cure, or prevent any disease.
Important Health Notice: Before using any dietary supplement, consult with your healthcare provider, especially if you are pregnant, nursing, have a medical condition, or are taking any medications.
4. Pricing and Payment
All prices are listed in United States Dollars (USD) and are subject to change without notice. We reserve the right to correct any errors in pricing.
Payment is processed securely through Square, Inc. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge your payment method for the total amount of your order.
In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price and will notify you promptly. We will refund any amounts charged for cancelled orders.
5. Orders and Shipping
All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or suspected fraudulent activity.
Shipping times are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs, weather, or other circumstances beyond our control.
Risk of loss and title for products pass to you upon delivery to the carrier. You are responsible for inspecting products upon delivery and reporting any damage or discrepancies within 48 hours.
6. Returns and Refunds
We want you to be satisfied with your purchase. If you are not completely satisfied, you may return unopened products within 30 days of delivery for a full refund of the purchase price (excluding shipping costs).
To initiate a return, please contact us at info@trithoshealth.com with your order number and reason for return. You are responsible for return shipping costs unless the return is due to our error or a defective product.
Opened products may not be returned for health and safety reasons, except in cases of defects or quality issues. Refunds will be processed within 5-7 business days of receiving the returned product.
7. Intellectual Property
All content on this Site, including but not limited to text, graphics, logos, images, product descriptions, and software, is the property of Trithos Health or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.
The Trithos name, logo, trident symbol, and all related names, logos, and slogans are trademarks of Trithos Health. You may not use these marks without our prior written permission.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from this Site without our express written consent.
8. User Conduct
You agree not to:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRITHOS HEALTH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCTS GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

You agree to indemnify, defend, and hold harmless Trithos Health and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of another.

The Site may contain links to third-party websites or services that are not owned or controlled by Trithos Health. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
You acknowledge and agree that Trithos Health shall not be responsible or liable for any damage or loss caused or alleged to be caused by your use of any third-party sites or services.
13. Charitable Donations
Trithos Health donates 10% of net proceeds from each product sale to charitable organizations. The specific charity associated with each product is designated at our sole discretion. Our current creatine products support the Alzheimer's Association.
Charitable donations are made periodically and are not contingent upon individual purchases. We reserve the right to change the charitable organizations we support at any time.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in York County, South Carolina, and you consent to the personal jurisdiction of such courts.
15. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
16. Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Trithos Health.
17. Entire Agreement
These Terms, together with our Privacy Policy and Cookies Policy, constitute the entire agreement between you and Trithos Health regarding your use of the Site and supersede all prior agreements and understandings.
